Terms of Service
These Terms of Service ("Terms") govern your use of the NW Peak Fundraising platform and services operated by NW Peak Fundraising and Consulting LLC, an Oregon limited liability company.
Platform Licensing
Access to the NW Peak platform requires a paid license. Single-team licenses are $1,000 per campaign season. District bundles (up to 15 teams) are $10,000. Licenses are non-transferable and non-refundable once a campaign has launched.
Platform Fees
A 3% platform fee is deducted from all donations processed through the platform. This fee covers payment processing, platform infrastructure, and ongoing development. Example: on a $100 donation, the school receives approximately $97.00 after the 3% fee.
School Responsibilities
Licensed schools are responsible for obtaining appropriate consent from athletes, parents, and guardians before creating athlete accounts. Schools must comply with FERPA and applicable state student privacy laws. Schools are responsible for the accuracy of program and athlete information entered into the platform.
Prohibited Use
You may not use the platform for any unlawful purpose, to harass or harm others, to submit false information, or to attempt to access other users' accounts. Violations may result in immediate license termination without refund.
Payouts
Schools receive fundraising proceeds via Stripe Connect direct deposit after campaign closure and standard Stripe processing periods. NW Peak is not responsible for delays caused by Stripe or banking institutions.
Limitation of Liability
NW Peak's liability to any school or user is limited to the total fees paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
Intellectual Property
The NW Peak platform, P.E.A.K. System methodology, manuals, and all related materials are the intellectual property of NW Peak Fundraising and Consulting LLC. License grants use rights only — not ownership.
Governing Law
These Terms are governed by Oregon law. Disputes shall be resolved through binding arbitration in Oregon, except that either party may seek injunctive relief in Oregon courts.
